ZANESVILLE - A 59-year-old Zanesville man who previously pleaded guilty to raping an 11-year-old girl was sentenced Wednesday to 11 years in prison, the maximum he could have received
The sentence is mandatory, meaning he will serve every year.
Robert L. Smith, already a convicted sex predator when he was indicted in the case, pleaded guilty in Muskingum County Common Pleas Court to rape, a first-degree felony. In court, Assistant Muskingum County Prosecutor Ron Welch argued in favor of the maximum sentence, based in part on Smith's prior criminal history.
Smith has a 1990 conviction on a rape charge, according to the online sexual offender registry. As a result of that conviction, he was given a lifetime registration requirement as a sexual predator after he was released from prison in 2010.
In August 2015, Smith was convicted in municipal court of soliciting, a third-degree misdemeanor. Judge William Joseph fined him $250 in that case and suspended a 30-day jail sentence.
After Wednesday's sentencing, Welch said his office was satisfied by the outcome.
"We appreciate the bravery of the young victim in coming forward, and were pleased to resolve the case without her having to suffer through the additional trauma brought about by having to relive the experience by having to testify," he said.
Smith gained access to the victim through a family member, Welch said, and the victim disclosed the abuse to a parent. The negotiated plea was a result of concern expressed by professionals about the effect a trial would have on the victim.
A former doctor from Tulsa was sentenced Thursday to 14 years in prison for raping a then-12-year-old girl in 2014.
Jurors on Nov. 3 convicted 73-year-old Gerald Albert Snider of one count of first-degree rape against a victim younger than 14 after hearing 14 witnesses, including the girl, testify.
Snider was accused of raping the girl on Aug. 3, 2014, at a north Tulsa home while he was baby-sitting her and a boy. A witness reported seeing Snider sexually assault the girl before he locked the boy in a bedroom.
District Judge William Musseman upheld the jury’s 14-year sentence recommendation, telling Snider, “You were a respected member of the community, which makes this crime even more aggravating.”
The girl’s mother read a victim impact statement to the court that detailed the trauma she said was caused by Snider’s actions.
Snider did not address the allegations during his sentencing hearing. He did, however, list his professional accomplishments, volunteer service and history of medical issues.
But Musseman noted that Snider has a fraud conviction related to his medical career that resulted in his spending time in federal prison.
Oklahoma Board of Medical Licensure and Supervision records indicate that Snider’s license to practice expired June 1, 2016, and that his license was suspended from 1997 to 2002 after he was convicted in federal court. His employer was listed as Care Family Medical and Chiropractic in Tulsa.
Assistant District Attorney Tanya Wilson requested that Musseman sentence Snider to prison, saying that despite his deteriorating medical condition, the girl’s rape has negatively affected multiple people. A charge of aggravated possession of child pornography filed along with the rape case was dismissed Thursday.
Defense attorney Bud Howard pointed out that Snider is elderly and has multiple medical ailments, and he asked for Snider to be scheduled for a judicial review of his sentence in 2018. The request was rejected.

A state appeals court has issued a ruling that might doom a serial child rapist to spend the rest of his life behind bars.
The recent decision by a Superior Court panel rejected Michael Bonsignore's claim that he shouldn't be serving consecutive federal and state prison sentences for his multiple sex crimes.
The 49-year-old Pike County man is serving a 25-year federal prison term on a 2012 conviction for making child pornography. Once he's done serving that penalty, he must start a 20- to 40-year state prison term on his 2015 convictions for sexually abusing three children, including a 9-year-old girl with autism, over a five-year period.
Bonsignore pleaded guilty to crimes including rape of a child, rape of a mentally disabled person, and corruption of minors in the state case. Investigators said he filmed his assaults on the autistic girl and bragged about how he had made her scream in pain.
On appeal, Bonsignore argued that his federal and state prison terms should have been run concurrently since both involved penalties for the same type of criminal conduct.
In the Superior Court opinion rejecting that argument, Judge Mary Jane Bowes noted that it already has been determined that the federal and state prosecutions didn't subject Bonsignore to illegal double jeopardy. The sentences he is serving on his federal and state convictions involve "separate and distinct offenses," she found.
Having Bonsignore serve both sentences consecutively "is not clearly unreasonable given the heinous nature of (his) crimes," Bowes wrote.

MONTGOMERY, AL (WSFA) -
A convicted rapist has been arrested by the Montgomery Police Department and charged with sexual abuse and sexual torture of a child.
Derek Jermaine Perkins45, was arrested Tuesday in connection with a child sex abuse investigation that started on Dec. 2. Authorities said Perkins knew the victim, who was under the age of 12.
According to Montgomery County District Attorney Daryl Bailey, Perkins was previously convicted in 2015 on a 2013 rape charge. Records indicate the victim in that case was a 15-year-old girl. 
Perkins is listed on the Alabama Sex Offender Registry. He was out on probation at the time of the second arrest.
Bond was set at $90,000 and the suspect is being held at the Montgomery County Detention Facility.
