Adam L. Derby likely will spend the rest of his life incarcerated under a 1999 law that allows the state to classify Derby as a sexually violent predator.
A Boone County jury on Friday found Derby to be a sexually violent predator under the 18-year-old law that allows for the state to civilly commit those deemed as such indefinitely to the Missouri Department of Mental Health.
Derby, 34, who previously lived in Columbia, has three convictions for possession of child pornography and one for first-degree child molestation.
He served about seven years of a 15-year sentence for his most recent child porn conviction, out of St. Louis, and was paroled about a year ago, but the Attorney General’s Office filed the case seeking to keep him locked up in March 2016, claiming he would reoffend if he ever were released.
After deliberating for about 5½ hours Friday, seven women and five men agreed with the state and classified Derby as a sexually violent predator. Associate Circuit Judge Deborah Daniels gave Amy Clay, Derby’s public defender, until March 3 to file a motion for a new trial. However, Clay, who heads the Missouri State Public Defender Office’s Civil Defense Unit, isn’t hopeful that Derby ever will be free again.
“He will be in the care and custody of the Department of Mental Health for the rest of his natural life,” Clay said shortly after the verdict was read.
If Daniels overrules Clay’s motion for a new trial, it can be appealed to the Missouri Court of Appeals Western District. But getting someone out of the Department of Mental Health once they’ve been civilly committed there is nearly impossible, Clay said.
Attorneys have challenged the constitutionality of civil commitments for sex offenders over the last few years with some success. A federal judge ruled in September 2015 that the application of the Department of Mental Health’s program, called Sexual Offender Rehabilitation and Treatment Services, was unconstitutional because patients weren’t being released, no annual reviews were being done and there were not release procedures.
More than 200 people have been committed to the program since 1999 and, at the time of the judge’s ruling, none had been allowed to live outside of the program’s facilities in Fulton and Farmington, the St. Louis Post-Dispatch reported. A federal judge in Minnesota ruled that state’s similar program is unconstitutional when used as a punishment, and critics have questioned whether these types of programs, which exist in about two dozen states, actually rehabilitate people.
Clay estimated her unit defends about 12 people per year whom the state seeks to commit to the Department of Mental Health indefinitely.
Derby testified on his own behalf during the three-day trial, trying to convince the jury he had been reformed during his latest prison stint. He had victimized at least three children over the years and began looking at child pornography because he didn’t want to harm anyone else, Clay said in her closing argument. Derby said he had learned how to stop his predatory thoughts.
“I know I am not the man I was,” he said. “I have changed.”
Missouri Assistant Attorney General Katharine Dolin said in her final remarks to the jury that Clay’s claims that Derby had taken responsibility for his actions and had reformed were incorrect. Dolin said Derby had faked evaluations in prison showing that he had reformed.
“He continued to manipulate through his Department of Corrections time, and he’s manipulating you now,” Dolin told the jury.

A sexual predator who targeted young boys using a website called ‘Tagged’ has been jailed - after an employee at the social networking site spotted his indecent exchanges and alerted the police in America.
Christopher Thompson was chatting to a 12-year-old boy from Leigh on the site and exchanging indecent images.
An employee of the social networking site Tagged raised the alarm after discovering indecent images were exchanged between the pair.
The victim was traced to Leigh in Wigan, and Thompson, of North Road, Darlington was identified as the offender.
Thompson was arrested in July 2014 on suspicion of engaging in sexual activity in the presence of a child and released with strict bail conditions.
Police then seized his laptop and found thousands of indecent images of children stored on it.
In May 2015, Thompson was further arrested in Durham and remanded in custody, after he met an 11-year-old boy in a park, and took him to a garage where he engaged in sexual activities with him.
After launching an investigation into him, the force seized a mobile phone and found more indecent images of children.
He was also investigated by South Wales police and charged with further CSE offences, after he incited a man from Cardiff to rape a four-year-old boy, which the man did, and sent the video to Thompson to watch.
He has now pleaded guilty to a myriad of sickening offences against children including engaging in a sexual act with a boy, storing indecent images of children, and inciting another man to rape a four-year-old.
And the 26-year-old has been sentenced to 27 years and 8 months in prison at Teeside Crown Court.
Det Con Kevin Byrne, of TITAN, the north west regional organised crime unit, said: “Firstly, I want to commend the victims for supporting our investigation, during what has been a difficult time. “With their help, we have been able to ensure Thompson is behind bars and cannot prey on any more young boys.
Thompson is a depraved individual who sexually abused children online to fulfil his sexual fantasies.
“He knew full well how young the boys he abused were when he began his offending, and even continued his horrific acts after he had been arrested.
“I hope today’s sentence demonstrates our commitment to pursuing sexual predators, no matter where they are or how long it takes.”

A McHenry man is facing charges for possessing and disseminating child pornography.

Joseph Gould, 31, was charged Friday with three counts of dissemination of child pornography, Class X felonies, and seven counts of possession of child pornography, Class 2 felonies. If convicted of the most serious charge Gould faces up to 30 years in prison.

Gould’s arrest was part of an ongoing effort by the Illinois Attorney General’s Office to apprehend the most active offenders who download and trade child pornography online, according to a news release. Since 2006, the Illinois Internet Crimes Against Children Task Force has been involved in more than 1,200 arrests of sexual predators.

Investigators from the attorney general’s office, with the assistance of the U.S. Investigation and Customs Enforcement’s Homeland Security Investigations, the McHenry County Sheriff’s Office and the McHenry County State’s Attorney’s Office, conducted a search of Gould’s residence at the 400 block of North Hill Road. Gould was arrested after evidence of child pornography was found.

“I am absolutely committed to prosecuting individuals who engage in child pornography to the fullest extent of the law,” McHenry County State’s Attorney Patrick Kenneally said in a statement. “Our partnership with the attorney general’s office is a critical tool that helps us put the perpetrators of these inexcusable crimes behind bars.”

Gould is currently in McHenry County Jail custody in lieu of posting 10 percent of his $250,000 bond. He is expected to appear before Judge Michael Feetterer on Tuesday.


ALEXANDRIA, Va. (AP) - Authorities say a 50-year-old northern Virginia man who used to work as a teacher’s assistant in Texas has been sentenced to more than 8 years in prison for receiving and downloading child pornography.
The U.S. Attorney’s Office for the Eastern District of Virginia said in a statement that James Jeffrey Schroeder of Arlington was sentenced Friday to 100 months in prison. That’s after he pleaded guilty in October.
According to court documents, from approximately 1997 to 2015, Schroeder received and downloaded child pornography.
The statement says a review revealed more than 13,000 images and 400 videos of child pornography, including some that were “sadistic or masochistic” in nature.

Schroeder also faces 20 years of supervised released and was ordered to pay $182,000 in restitution to victims.
Federal prosecutors say a 27-year-old nursery school worker faces up to 20 years in prison after admitting he downloaded child pornography from an underground website infiltrated by law enforcement as part of a controversial federal sting operation.
James Paroline, of Red Bank, was first arrested in July 2015 after investigators traced downloads he made beginning that February from the Playpen, an underground website used to distribute child pornography.
Prosecutors say Paroline, who was also a summer camp counselor at an unspecified private school, downloaded multiple videos and photos of child abuse from the site between Feb. 26 and March 2 of that year.
Paroline, who was later indicted, pleaded guilty Friday before U.S. District Judge Freda L. Wolfson in Trenton to one count of receiving child pornography, according to the U.S. Attorney's Office.
He faces a minimum sentence of five years in prison and a maximum of 20, as well as a $250,000 fine.
While many child pornography arrests begin with law enforcement tracing suspicious internet activity, there's a key difference in Paroline's case: The site he downloaded the images from was reportedly being run by law enforcement.
The Dallas Morning News reported that FBI agents in Virginia obtained a federal warrant in February 2015 that allowed them to continue to operate the site on government computer servers for up to 30 days.
Agents would then hack the computers of people who accessed the site in order to determine their locations, the Morning News reported.
The operation reportedly led to criminal charges against 180 people throughout the country, but tens of thousands of images continued to be uploaded to the site while investigators controlled it, the report said.
In Paroline's case, federal prosecutors in New Jersey sought and obtained a protective order in October barring defense attorneys from disclosing details of what authorities described in court filings as the government's "network investigative technique."
While the FBI has declined to comment publicly on the operation, federal prosecutors previously have stressed in published reports that the Playpen investigation was court-authorized and short-term, arguing it was their only chance at identifying the site's users.

MOUNT GREENWOOD — A Mount Greenwood man found with child pornography and has been arrested and charged with two felonies, according to Chicago police.
Russell Rhoads of the 10700 block of South Homan Avenue was arrested at 3:45 p.m. Thursday after police found child pornography on his computer. The victim was younger than 13, a police spokesman said Monday.
Rhoads, 51, lives just one block north of Mount Greenwood Elementary School and roughly two blocks west of McKiernan Park.
Ald. Matt O'Shea (19th) sent an email to his constituents Friday about the charges, saying he's been in contact with the Cook County State's Attorney's Office.
"Working together with residents and law enforcement, we will pursue the most aggressive possible prosecution. Moving forward, I will keep the community updated on the court proceedings," he said.
"This man was clearly a threat to the safety of our children," O'Shea said.

A Salem man was arrested after a Marion County grand jury indicted him on 15 counts of first-degree encouraging child sex abuse.
A grand jury indicted Kyle David Boyd, 34, on Jan. 23 and a warrant was issued for his arrest. Salem police arrested Boyd on Saturday. He was taken to Marion County jail and held on $300,000.
Boyd is accused of downloading or duplicating visual recordings of sexually explicit conduct involving a child 15 times between 2011 and 2015, according to an indictment filed in Marion County,
He did so even "while knowing the creation of the visual recording of the sexually explicit conduct involved child abuse," according to the indictment.
A Salem police detective and representative from the Oregon Department of Justice testified before the grand jury.
Boyd, a longtime employee of Gallagher Fitness Resources, has run in several local races.

A man was caught with indecent images of children on two laptops after landing at a Canadian airport.
Carlton Taylor aroused suspicion when he landed in Calgary with 50 electronic devices including the laptops and very little else.
Appearing at Carlisle Crown Court, he pleaded guilty to three counts of making indecent images of children.
The 59-year-old of Romney Road, Kendal, Cumbria, was given an eight-month jail term suspended for two years.
He also admitted one charge of possessing the illicit material including on 19 mobile phones.
The hearing was told how Taylor aroused suspicion when he arrived at the airport on a flight from the UK with lots of electronic devices and few other belongings in October 2015.
Officials analysed the devices and found 14 still and moving indecent images, six of which were Class A - the most serious category.
Recorder Michael Murray also gave him a 20-day rehabilitation order and a three-month night-time curfew.
Taylor must also sign the sex offenders register and was made subject to the terms of a sexual harm prevention order for an indefinite period.


MUSKOGEE, Okla. -- Police in Muskogee have made a second arrest amid a continued investigation into a child pornography case.
During the investigation, police obtained an arrest warrant for Melissa Skelton for child sexual abuse and conspiracy to commit child sexual abuse.
On February 3, U.S. Marshals arrested Skelton as well as obtaining additional evidence in the case.
Earlier in January, police arrested Muskogee firefighter Zachary Perry, 30, for possession and distribution of child pornography.
Additional charges against Perry are being forwarded to the district attorney for review. The charges include human trafficking, child sexual abuse, and conspiracy to commit child sexual abuse.
Muskogee Police ask that anyone with concern over their child's potential exposure to Perry contact them at 918-680-3183.

NORFOLK, Va. — A Virginia man who forced an 11-year-old into child pornography has been sentenced to 17 years in prison.
Federal authorities said Monday that 43-year-old Robert Lee Petty must also spend the rest of his life on supervised release once he gets out.
Prosecutors said the Virginia Beach man viewed the pornography he forced the child to produce. It allegedly went on for five years.
This case was part of a nationwide initiative launched by the Department of Justice to combat the growing epidemic of child sexual exploitation.


LONG BEACH, N.Y. (AP) — A suburban New York clergyman has been arrested after police say they found child pornography on his computer devices.

Vicar Christopher King of St. James of Jerusalem Episcopal Church in Long Beach was arrested at 6 p.m. Friday.

Nassau County police say detectives found pornographic images of children under 16 on King’s devices.

Police say they also found methamphetamine, Xanax and drug paraphernalia at King’s residence in the church parish hall.

The 51-year-old King was expected to be arraigned Saturday on charges of possessing a sexual performance by a child and criminal possession of a controlled substance.

King did not respond to a message left on his cellphone. It’s not clear if he has an attorney who could speak on his behalf.




Lawyers, lawmakers and activists call for better implementation of a consolidated law to protect vulnerable children from multiple threats — inside and outside homes, at work, and now from the burgeoning porn industry targeting kids


Many hurdles lie in the way of making society safe for children even as new threats — such as the growing child porn industry -- keep emerging.

Children’s activist Vidya Reddy said technology was having an influence on child abuse. She was speaking at a national symposium at the National Law School in the University of Bengaluru on Saturday where deliberations were held over the proper implementation of the 2012 POCSO Act. Its aim is to consolidate several fragmented laws aimed at protecting children.

Reddy told the audience about a Facebook page that used Tamil written in English and asked its group members for responses to innocuous images of young girls going to school or playing, or eating an ice cream. The most outrageously graphic comments followed the question: what would you like to do to her?

She said child rapists were discovering and validating each other on the internet, a growing trend in India. She said it was not just consumers actively seeking child porn online, but child porn actively seeking abusers, too, as the burgeoning industry recruited new purveyors in India. This is the cruellest form of modern child abuse, Reddy said. Goa was becoming a hub where girls and boys were widely exploited.

Suchismita Bose, a psychologist who started The Foundation, an equal rights NGO based in Mumbai, said many people creating and consuming such material, though criminal, were not necessarily all offending paedophiles in the physical world.

Things become complicated with children posting photos of themselves and each other: “It’s not just the racket and the ring but also children against children. It is difficult to determine whether they are just being sexually explorative or if they had real criminal intent, or were bullies. Some children may not realise what a digital imprint they were leaving,” she said.

A Google Trends analysis indicated that searches for ‘teen porn’ more than trebled between 2005-2013. Total searches for teen-related porn reached an estimated 500,000 daily in March 2001.

Child porn is a multi-billion dollar industry, anywhere between $3-30 billion, though a clear, reliable figure is not available.

Sadly, insensitivity and a lack of awareness is why authorities first trivialise complaints, said Flavia Agnes, a partner at the Bombay-based lawyers’ collective, Majlis. She was the opening speaker at the event.

Rajeev Chandrasekhar, Rajya Sabha MP, said he once had a distraught young mother of a two-year old come to his office on MG Road to report that her child had been raped while at school. He picked up the phone to call a local minister to take action, whose unashamed response was: “Who asked the mother to work?” Such ludicrous reactions would be laughable if they weren’t the dominant attitude among politicians, police, lawmakers, and even judges.

Attitudinal hurdles, or the institutionalised unseeing of the vulnerability of victims means most of the accused in child rape cases never see the inside of a jail.

Chandrasekhar called the inaction of government a “conspiracy of silence”.

Judges, say lawyers, remain setbacks. “There is no clear understanding of consent. Or sexuality and sexual choices. What is understood very well, though, is the vague and sanctified invention of sexual purity -- who is a victim, they ask? If she has a boyfriend then she is not seen as being worthy of any protection,” Flavia Agnes said.

“Until 1995, rape within the family was not considered a serious offence. ‘Maybe the girl was very manipulative,’ the prosecutors say. Or, ‘the girl didn’t fight’. Girls must always think chastity is their most important possession and they would rather die fighting than be dishonuored.’ These are the kinds of things judges still say. ‘Where is the injury,’ they ask?” she said.
